Study on international protection statutes in Latin America
This gap-filling study maps the various international protection statuses in the domestic law of numerous Latin American states, departing from an extended understanding of the term “international protection”. Although this notion arose from the refugee concept contained in the 1951 Convention relating to the Status of Refugees and its 1967 Protocol, by today, it has evolved to cover a much broader category of people in need. This evolution is testified to by a 2014 Advisory Opinion of the Inter-American Court of Human Rights (IACtHR) and the 2017 innovative definition provided by the United Nations High Commissioner for Refugees (UNHCR). The study reveals a variety of protection statuses in the region beyond classic refugee status, including complementary and humanitarian protection, as well as specific protection measures for stateless persons, victims of trafficking and unaccompanied minors.
